Lake Buena Vista Resort, LLC – Lake Buena Vista, Florida

Urban Thier & Federer, P.A., has represented and continues to represent a number of purchaser clients in the Lake Buena Vista Resort development who are seeking to terminate their Condominium Purchase Agreement/contract and recover their deposits. Lake Buena Vista Resort, LLC, is planned for a total of 12 buildings, of which only five have been built. Urban Thier & Federer, P.A., is accepting cases for purchaser clients in the Lake Buena Vista Resort development who have contracted to purchase a condominium unit, but who have not taken ownership (have not closed on the purchase) of their unit(s).

A review of the various state and federal court dockets/public records indicates that Urban Thier & Federer, P.A., is the only law firm to have been able to recover purchaser clients’ entire deposits. This law firm has settled many cases and has taken many other cases to final judgment, securing final judgments in favor of its client purchasers and against Lake Buena Vista Resort, LLC, for the entire deposits paid plus interest, attorney fees and costs.

In a case that received national attention, Harvey v. Lake Buena Vista Resort, L.L.C., 568 F.Supp.2d 1354 (M.D.Fla. 2007) affirmed Harvey v. Lake Buena Vista Resort, L.L.C., 306 Fed.Appx. 471 (11th Cir. 2009), Urban Thier & Federer, P.A., represented a United Kingdom resident husband and wife in the United States District Court for the Middle District of Florida. In that case, this law firm filed a lawsuit on behalf of its purchaser clients in federal court for violations of the Interstate Land Sales Full Disclosure Act, Florida Statutes Chapter 718, Breach of Contract and other causes of action against the defendant developer, Lake Buena Vista Resort, LLC, to recover their $77,800.00 deposit.

Based upon this law firm’s motion for summary judgment (trial on paper, which eliminated any need for the purchaser clients to have to appear in Florida in relation to the lawsuit), the federal court entered a final judgment terminating the parties’ purchase contract and awarding this law firm’s purchaser clients their full deposit plus attorney fees, interest and costs. Lake Buena Vista Resort, LLC, appealed the decision to the Eleventh Circuit Court of Appeals (the federal appellate court for all federal courts in the states of Alabama, Florida and Georgia). The Eleventh Circuit Court of Appeals three judge panel unanimously affirmed the federal trial court’s final judgment and this law firm’s purchaser clients recovered over $150,000.00 in deposits, fees, interest and costs.
