In the US, in order to clear title to assets such as tangible and real property after a person has passed away, it is frequently necessary to open a probate case in the appropriate court. In the process, an estate will be opened and usually, a person will be appointed to represent the estate. The estate pays debts of the deceased, inclusive of taxes and eventually transfers ownership of assets to the living beneficiaries.
