Making and Litigating a Spanish Law 57/68 Claim with the UTFPA Team

The UTFPA Team believes that our willingness to handle your entire case from start to recovery of funds on your behalf on a single “No Win No Fee”/Contingency fee basis of 35% of any actual recovery speaks volumes.  Other attorneys, and non-attorneys, may claim that they can help you, but are they willing to work for free unless and until they have recovered funds on your behalf?

Once we have determined that you have a viable Spanish Law 57/68 claim, we will involve the Spanish lawyers, who will also review the file for eligibility and completeness.  Only if the Spanish lawyers independently agree that you have a valid claim will your claim proceed to the lawsuit phase.

It is at this point that the Spanish lawyers will need a notarized limited Power of Attorney, appointing them to act on your behalf in the Spanish courts, and a 500 Euro Spanish court case filing cost will also need to be paid at this time in order to file and initiate your Spanish lawsuit.

If you prefer, UTFPA can advance these costs (which are paid to a notary of your choice and the Spanish clerk of court) on your behalf and recover them from your share of any recovery at the end of your case.
Once your case is won, the Spanish Court will enter a judgment on your behalf for the full deposit amount plus interest from the date that you paid your deposit to the Spanish bank to the date of the judgment.

Once the funds awarded by the Judgment are collected from the Spanish bank, you will receive a detailed accounting listing all funds received, accounting for the 35% UTFPA Team fee and, for those clients for whom UTFPA advanced notary and/or court filing costs, deducting such advanced costs from the client’s 65% of the total recovery.

No other fees or costs whatsoever are deducted by any member of the UTFPA Team, or anyone else, from the funds recovered on your behalf.
