Making and Litigating a Spanish Law 57/68 Claim with the UTFPA Team
This article will go through the process of making a Spanish Law 57/68 claim and give an overview of what to expect after you contact UTFPA. We encourage you to read our related article (Spanish Law 57/68 Bank Guarantees) providing background and details regarding Spanish Law 57/68.
We also encourage you to review our related Frequently Asked Questions (FAQ) article. These articles explain the Spanish Law 57/68 and the importance of doing your own due diligence and selecting a legal and administrative team with a proven track record, experienced attorneys and the resources to see your case through the Spanish trial courts and, if necessary, appellate courts.
The Urban Thier & Federer, P.A. (“UTFPA”) Team, is made up of
- UTFPA – an established international law firm with offices in the United States and Europe, that has litigated many 100s of lawsuits on behalf of well over 1,000 international property investors, terminating their contracts and recovering deposit funds,
- a claims company – this part of the UTFPA Team works with UTFPA on the administrative aspects of signing up with the UTFPA Team, screening prospective clients for eligibility, assisting in compiling relevant documents and otherwise helping gather all of the information and documentation for each client’s unique case to build the strongest claim possible, and
- the Spanish lawyers – once our team has determined that you are eligible to make a claim, the Spanish lawyers perform an independent file review and, if in agreement, will proceed to file your lawsuit and litigate your case to conclusion.
Throughout the entire process, you will always be able to speak with an attorney if you so wish. All three elements of the UTFPA team have English speaking staff.
The UTFPA Team believes that our willingness to handle your entire case from start to recovery of funds on your behalf on a single “No Win No Fee”/Contingency fee basis of 35% of any actual recovery speaks volumes. Other attorneys, and non-attorneys, may claim that they can help you, but are they willing to work for free unless and until they have recovered funds on your behalf?
We believe that this willingness to share the risk of no recovery with our clients and waiting to be paid, demonstrates the fact that we are confident that we will not only win your case but also recover funds on your behalf. In addition, the track record of our team approach also speaks for itself – every Spanish Law 57/68 case brought to conclusion has resulted in a clear win for our clients with a recovery of the deposits plus interest.
Once you contact the UTFPA Team, via the “Contact Us” form on this page, you will promptly be contacted by UTFPA and we (UTFPA and the claims company) will immediately start working with you to get you signed up, screen your claim for eligibility, and start compiling the information and documents related to your unique case and circumstances.
Once we have determined that you have a viable Spanish Law 57/68 claim, we will involve the Spanish lawyers, who will also review the file for eligibility and completeness. Only if the Spanish lawyers independently agree that you have a valid claim will your claim proceed to the lawsuit phase.
It is at this point that the Spanish lawyers will need a notarized limited Power of Attorney, appointing them to act on your behalf in the Spanish courts, and a 500 Euro Spanish court case filing cost will also need to be paid at this time in order to file and initiate your Spanish lawsuit.
If you prefer, UTFPA can advance these costs (which are paid to a notary of your choice and the Spanish clerk of court) on your behalf and recover them from your share of any recovery at the end of your case.
Once your case is won, the Spanish Court will enter a judgment on your behalf for the full deposit amount plus interest from the date that you paid your deposit to the Spanish bank to the date of the judgment.
Once the funds awarded by the Judgment are collected from the Spanish bank, you will receive a detailed accounting listing all funds received, accounting for the 35% UTFPA Team fee and, for those clients for whom UTFPA advanced notary and/or court filing costs, deducting such advanced costs from the client’s 65% of the total recovery.
No other fees or costs whatsoever are deducted by any member of the UTFPA Team, or anyone else, from the funds recovered on your behalf.
We look forward to the opportunity to work with you, to be of service to you, and to assist you in recovering your deposit(s). If you wish to pursue a Spanish Law 57/68 claim, PLEASE LET US KNOW AS SOON AS POSSIBLE by completing the “Contact Us” form on this page.
For those who do, we will immediately have the UTFPA Team screen your case and, if determined eligible, move your claim forward.
Your agreement will be with the claims company, which will further review all documentation to determine your eligibility. If determined eligible, the Spanish lawyers will be tasked via your limited power of attorney to proceed in enforcing your legal rights in Spain via the Spanish courts.
Please include your email address and your full name in the subject line of your communications with UTFPA. Please feel free to share this information with others who may be eligible for recovery.
We encourage you to become informed of your rights and options. You should also ensure that any law firm or claims company you consult or retain to represent you has the experience, resources and ability to take your case through trial and appellate courts, if necessary.
