Urban Thier & Federer, P.A., and attorney John L. Urban, has a long track record of successfully representing many 100’s of clients seeking to terminate their Florida pre-construction contracts and purchase agreements for condominiums in Florida and to recover their deposits. With changes in financial circumstances, interest rates and other factors, many individuals and businesses that entered into contracts to purchase a not yet completed, preconstruction, or off-plan condominium unit have contacted us seeking to exit the purchase agreement and recover their deposits paid, which deposits are often in the $100,000s.
You can rest assured that the developer or seller of the condominium has a team of attorneys that worked to write your purchase agreement and to make it as one sided in favor of the seller as possible. As a result of the years of overreaching by developers, Florida statutory laws provide strong protections to purchasers. However, these protections are mostly technical in nature and, even after you sign the purchase agreement, the developer’s team of attorneys often continues to work to amend the purchase contract and otherwise protect the developer and lull you into waiving your rights, often claiming that an amendment or addenda to the purchase agreement or other disclosure is simply a minor routine matter when, in fact, it is a waiver of your rights.
If you wish to terminate your purchase agreement and recover your deposit, we urge you to take immediate action and sign no further documents whatsoever with the developer.
At every step of the way along the contracting and purchase process, the developer will push you to complete your purchase. Clients are often threatened by the developer, or the developer’s attorneys, with being declared in breach of the purchase agreement, losing all of their deposit funds, and/or facing legal action for breach of the purchase agreement, and/or having to pay the developer’s attorneys’ fees, performance the contractual purchase obligations, etc. all in an effort to keep purchasers from pursuing their legal rights.
Under our proven legal strategy, we seek to have your contract rescinded, meaning you are legally put back into the position you would have been in had you never entered into the contract or purchase agreement for sale in the first place. Under this strategy, you are entitled to a return of your entire deposit(s), your purchase obligation is permanently terminated, and you may also be entitled to an award of interest, attorney fees, and costs.
Regardless in which development or with which developer you have contracted, we can analyze your contract and circumstances to determine if we have a strategy that we believe will be successful for you and your situation. If we agree to accept your case, we represent you on a No Win No Fee/contingency fee basis.
